LLC May Shield Liability for COVID Injuries under Arizona Law

On April 5, 2021 Governor Doug Ducey signed into law S.B. 1377. The measure limits a person or provider from damages in a civil action or injury from the pandemic, as long as the person or provider acted in good faith to protect another from injury during a public health pandemic. Thus, a plaintiff would need to prove that the person or provider acted with willful misconduct or gross negligence.

The law is very broad sweeping and providers include most business, schools, property owners, property managers, the government, and churches.


The law is a retroactive law that applies from and after March 10, 2020.
